We reserve the right to modify, suspend, or discontinue any service at any time with or without notice.

• AI-generated content may contain errors, inaccuracies, or biases.
• AI outputs do not represent the views or opinions of EganForge LLC.
• You are solely responsible for reviewing, verifying, and deciding how to use any AI-generated content.
• EganForge makes no warranties regarding the accuracy, completeness, or fitness for any particular purpose of AI-generated outputs.

8. Payment Terms

• Paid services are billed through Stripe. You agree to pay all applicable fees.
• Subscription fees are billed in advance on a recurring basis (monthly or annually).
• All fees are non-refundable except as required by applicable law or as explicitly stated.
• We reserve the right to change pricing with 30 days' notice.

9. Intellectual Property

• All EganForge services, software, content, trademarks, and trade dress are owned by EganForge LLC and protected by applicable intellectual property laws.
• You retain ownership of content you submit to our services.
• By submitting content, you grant EganForge a non-exclusive, worldwide license to use that content solely to provide and improve our services.
• AI-generated outputs created through our tools may be used by you, subject to applicable third-party model provider terms.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EGANFORGE LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER IN AN ACTION IN CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR USE OF OUR SERVICES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO EGANFORGE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless EganForge LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of our services, your violation of these Terms, or your violation of any rights of a third party.

12. Dispute Resolution

Any disputes arising from or relating to these Terms or your use of our services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration shall take place in the State of West Virginia. You agree to waive any right to a jury trial or to participate in a class action.

13. Termination

• We may suspend or terminate your access to our services at any time, with or without cause, with or without notice.
• You may terminate your account at any time by contacting us at support@eganforge.com.
• Upon termination, your right to use our services immediately ceases.
• Sections regarding liability, indemnification, and dispute resolution survive termination.

We reserve the right to modify these Terms at any time. Material changes will be posted on this page with a revised effective date. Your continued use of our services after modifications constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of West Virginia, United States of America, without regard to its conflict of law provisions.
